As America’s multi-billion dollar opioid lawsuits move slowly toward resolution, insurance coverage confusion is mounting. Recent decisions have wrestled with the distinction between insurance coverage for bodily injury claims and claims seeking funding for future governmental social services.

In recent weeks, new insurance coverage suits have been filed seeking public nuisance claims against several opioid distributors. If the courts continue to blur the line between claims for individual injury and government abatement funding, insurance policies may be depleted well in advance of any individual bodily injury claim payouts.
