Federal Court Vacates Duty to Defend Ruling in Wrongful Conviction Case And Finds No Duty to Indemnify

On September 13, 2017, the U.S. District Court for the Northern District of Illinois vacated a prior 2014 ruling that Westport Insurance Corporation was required to defend a wrongful conviction claim against the City of Waukegan. In obtaining vacatur of the 2014 ruling, BatesCarey’s Adam H. Fleischer, R. Patrick Bedell and Justin K. Seigler defeated the insured’s claims that Westport owed over $500,000 in defense costs, as well as $7.5 million in indemnity arising from the wrongful imprisonment of Juan Rivera, whose second of three trials took place during the Westport period.
