Hearing on Consolidation Signals New Phase for Opioid Suits
Adam Fleischer and Kevin Harris of BatesCarey’s Opioid Coverage Task Force published an article on Law360.com discussing the significance of the Judicial Panel on Multidistrict Litigation’s possible consolidation of opioid litigation pending nationally into a single multidistrict litigation or “MDL”. The team attended the hearing on November 30, 2017 in St. Louis and provides valuable insight into the significance of MDL for opioid litigation, the parties’ arguments for and against MDL, and the court’s concerns about the efficiency and convenience of consolidation. As county and local governments continue to file suit, and as hospitals, labor unions, and individuals join the fray, opioid litigation may be entering a new phase that interested parties need to understand.
