This panel discussion will focus on solutions for Bermuda insurers seeking to enforce their Bermuda or London arbitration clauses when sued in a state or federal court in the United States.
Topics of the discussion will include:
- How parallel action in a Bermudian or U.K. court may be used to assist enforcement of an arbitration clause in a U.S. court.
- Objections to jurisdiction and venue in U.S. courts.
- The New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
- The interplay between state and federal courts in the United States and how it affects strategy for enforcement of a Bermuda or London arbitration clause.
